2. Prices
All prices are stated in Danish kroner incl. VAT, all taxes and costs.
3. Payment
The purchase price is due at the time of ordering.
4. Product information and changes
The Seller’s product is described on the Seller’s website.
Information about the product is only binding to the extent that the Seller expressly refers to it in writing. The Seller reserves the right without notice to make changes to all product specifications, if this can be done without significant inconvenience to the Buyer.
5. Ordering
Purchases and orders are made via the Seller’s website.
On the website you can pay with the following payment cards: Visa/Dankort and Mastercard, as well as MobilePay.
Transaction fees are stated before purchase and do not exceed the rates set by Nets.
When you place an order, your debit card will be authorised. If your card is not authorised, you will receive an on-screen notification that the authorisation failed, and you will then be asked to select another payment method. The amount is deducted from the card/MobilePay when placing an order.
6. Delivery time
6.1 The delivery time is in accordance with the receipt that the Buyer receives after ordering via the Seller’s website.
6.2 If the Buyer is delayed by more than 15 minutes, then the Seller may without liability consider the agreement as a material breach of the Buyer, in that the Seller is then entitled to terminate the agreement. If one or more of the Buyer’s members should be delayed, then the Seller may without liability consider the agreement as a material breach of the Buyer, as the Seller is then entitled to terminate the agreement in respect of only the person or persons who have been delayed. The Seller is entitled to full payment under the agreement.
7. Defects and complaints
The buyer must complain without undue delay, which is to say at the latest at the time of the event’s completion. If the Buyer has or should have discovered the defect, and the Buyer does not complain as described, the Buyer cannot later assert a claim concerning the defect.
At the Seller’s choice, defects in the goods sold will be remedied, redelivered, or the purchase price of the goods sold will be credited to the Buyer.
No guarantee is given on the services provided.
8. Limitation of Liability
8.1 For claims relating to the Seller’s fulfilment or non-fulfilment of its obligations, the Buyer is entitled to compensation for direct losses with the following limitations:
8.2 The Seller’s liability is limited to direct damages/losses, and is – regardless of the reason and regardless of the nature of the claim – limited to the largest of the following two amounts: DKK. 50,000 or the amount invoiced for the service that caused the damage/loss or is the cause of or directly related to the claim.
8.3 The Seller is under no circumstances liable to the Buyer for lost profits, lost savings or other indirect losses or consequential damages due to the use of the goods sold or inability to use them, regardless of whether the Seller has been informed of such claims.
8.4 The Seller is not responsible for the Buyer’s physical or mental condition, including in relation to the service. The Buyer is obliged to ensure that the Buyer can participate in the service without risk to the Buyer.
9. Right of cancellation
9.1 Pursuant to the Danish Consumer Contracts Act (“Lov om visse forbrugeraftaler”) § 17 para. 2 cf. § 9 para. 2 no. 2a, the purchase of entertainment events is NOT covered by the right of cancellation.
Special conditions regarding cancellation or change of time:
Bookings made 31 days before the event date are binding and cannot be cancelled or changed without charge.
Cancellation must be made online on the Seller’s website no later than 21 days before the event.
In the case of cancellation 8-31 days before the event, a charge of 25% of the invoice amount is payable (however, a minimum of DKK 500 in administration fee).
In case of cancellation 4-7 days before the event, a charge of 50% of the invoice amount is payable (however, a minimum of DKK 500 in administration fee).
In the case of cancellation 1-3 days before or on the same day as the event is booked for, the entire invoice amount is retained.
Products purchased on promotion or at a discount are not rebookable or refundable.
Gift cards are non-refundable.
10. The processing of your personal data
10.1 We process your personal data in accordance with the legislation in this area.
10.2 In connection with the delivery of the service, the participants are filmed. The recordings are deleted immediately after the service has been delivered.
11. Force majeure
11.1 The Seller is not liable to the Buyer for losses arising from circumstances of an unusual nature and which prevent, obstruct or increase the cost of fulfilling the agreement, if these occur after the offer is made and are outside the Seller’s control, including: labour disputes (strikes and lockouts), wildfires, war, insurgency, civil unrest, weather and natural disasters, currency restrictions, public seizure, import or export bans, traffic disruption, including energy supply, significant price and/or tax increases, currency fluctuations, production and delivery difficulties, which are due to conditions that cannot be blamed on the Seller, as well as the occurrence of force majeure and/or hardship with relevant subcontractors.
Until 1 April 2021, we have suspended refunds due to force majeure, but all cancellations can be booked free of charge for a new time. Cancellations 48 hours before booking, however, follow the usual provisions and cannot be changed.
12. Product liability
12.1 With respect to product liability, the Seller shall be liable in accordance with the rules of Danish law on product liability. The Buyer must immediately notify the Seller if a third party asserts product liability to the Buyer. In the absence of relevant mandatory rules, the Seller shall not be liable for production losses, loss of profit or other indirect losses.
12.2 If the Seller is sued by a third party in connection with product liability, the Buyer shall honour a possible summons to attend or accept becoming a co-defendant at the court that handles the case.
12.3 If the Buyer does not return puzzle books issued in connection with the purchase of RiddleHunt, the Customer will be charged DKK 200 incl. VAT per book that is not returned to the place where it was issued.
13. Disputes, choice of law and competent court
13.1 Disputes between the parties that cannot be settled amicably must be settled at the City Court in Roskilde under Danish law. However, Danish private international law referring to foreign law and the Convention on Contracts for the International Sale of Goods (CISG) do not apply.
